Perú: Support Anti-Discrimination Measures in New Constitution

SUMMARY

The Peruvian Parliament has embarked upon the process of amending the national Constitution. Civil society has been called upon to provide suggestions. Seven lesbian, gay, bisexual and transgender non-governmental organizations have created a coalition called FREDIF (Right to be Different Front - Frente por el Derecho a ser Diferente), supported also by women's, human rights and other organizations. FREDIF is promoting the inclusion of "sexual orientation" as a protected category against discrimination in the new Peruvian Constitution. .

ACTION

FREDIF is asking for letters in support of their initiative.

Estimadas/os Señoras y Señores congresistas:

Las organizaciones y personas que abogamos por los derechos humanos de todas las personas, así como por legislaciones y políticas inclusivas de la diversidad, venimos observando con grandes expectativas el proceso de reforma constitucional iniciado en el Perú. Dentro del proceso de reconstrucción de la democracia en el Perú, el debate que se ha abierto para la inclusión de las perspectivas de la ciudadanía peruana demuestra una clara intención de diálogo con sectores tradicionalmente excluidos de la sociedad.

En este contexto propicio, quisiéramos llamar su atención sobre las violaciones a los derechos humanos de las personas con una orientación sexual distinta a la norma heterosexual. Estas personas - sean lesbianas, homosexuales, bisexuales, personas transgénero o travestis - experimentan diversas formas de violencia y discriminación por el solo hecho de no ser heterosexuales.

La inclusión de una cláusula prohibiendo la discriminación por orientación sexual en la Nueva Constitución del Perú brindaría una protección legal indiscutible para dicha población. Consideramos que éste es uno de los pasos necesarios para garantizar que los derechos humanos para todas las personas sea una realidad en el Perú.

Dear Congresswomen and Congressmen,

Organizations and individuals advocating for the human rights of all persons, as well as for legislation and policy that includes all forms of diversity, have been looking with great expectation at the process of Constitutional amendments that has started in Peru. In the framework of rebuilding democracy in Peru, the opening of a debate that allows for inclussion of Peruvian citizens viewpoints shows a clear intention to dialogue with sectors that had been traditionally excluded from society.

In this favorable context we would like to draw you attention to those human rights violations suffered by people whose sexual orientation differs from the heterosexual norm. Those people -be them lesbians, homosexuals, bisexuals, transgender people or transvestites- experience different forms of violence and discrimination for the mere fact of their not being heterosexuals.

The inclussion of a clause forbidding discrimination based on sexual orientation in the new Peruvian Constitution will provide unquestionable legal protection to those populations. We consider this a one of the necessary steps to ensure that human rights for all become a reality in Peru.
