Poland: Polish Constitution Does Not Include Sexual Orientation

Despite attempts by both national and international activist to insure the retention of an early draft of the human rights clause, the newly adopted Polish Constitution does not include sexual orientation as one of the grounds for non-discrimination.

The draft of Article 2 Paragraph 2 reads: "Nobody can be discriminated against because of their sex, race, national or ethnic background, health, physical or mental disability, social background, place of birth, sexual orientation, language spoken, religious faith or lack therereof, opinions, material status or for any other reason." The new human rights clause now reads: "Nobody can be discriminated based on any grounds in the political, social or economic life."

Aside from removing the specific mention of sexual orientation, the new constitution gives another blow to the rights of gays and lesbians in Poland by defining marriage in Article 18 as a relationship between a man and a woman.
