Last Update:

In the Federated States of Micronesia, same-sex sexual activity is legal and has never been criminalized. Since 2018, discrimination on the basis of sexual orientation has been banned in areas such as employment, housing, education, and public services. However, same-sex marriage is not recognized, which means that there are no legal rights or benefits tied to marriage, such as inheritance rights, tax benefits, or spousal protection. There is no administrative framework to allow people to change their legal gender markers.

In 2018, the country held its first Pride event in the state of Pohnpei, a result of community organizing by a group of LGBTIQ individuals, activists, and allies. LGBTIQ organizations and informal networks in Micronesia engage in grassroots organizing and national advocacy and participate in regional networks such as the Pacific LGBTQI Network.

In 2023, Micronesia issued a statement strongly supporting the inclusion of marginalized groups, including those facing discrimination on the basis of sexual orientation and gender identity, in the debate over a UN resolution on promoting democracy and enhancing periodic and genuine elections. Earlier in 2018, a Micronesian Senator filed a bill to prevent trans people from working for the national government, but there was no further action taken, and it was not enacted into law.
